General terms and conditions of guarantee and delivery

1) Guarantee conditions for wind turbines

2) Wind turbine warranty conditions for deliveries using customer’s own parts and equipment such as. the customer’s own mast

3) Warranty conditions for grid-connected Solar E and E+ photovoltaic systems

We provide a 5-year warranty from the date of delivery for our turnkey installed photovoltaic system.
The warranty covers defects in materials and workmanship of parts and equipment. The warranty also covers the replacement of defective parts and equipment up to the agreed interface, provided that the installation has been carried out by Finnwind Oy or an authorised installer of Finnwind Oy. The purchaser must notify the guarantor of the defect without delay when he discovers the defect. Upon notification, Finnwind Ltd will start to investigate the defect in cooperation with the Buyer and will take corrective action within a reasonable time.
In case of a defect under warranty, Finnwind Ltd has the right to repair or replace the defective part or device at its discretion. The warranty terms and conditions of the manufacturers of grid inverters and solar panels shall be used to determine and define the warranty defect. For individual solar panels, Finnwind Ltd shall be entitled, in addition to the repair and/or replacement of the solar panel, to refund to the customer the market value of a new equivalent solar panel at the relevant time. In the latter case, the rated output of the solar power plant may be reduced from the original. Limitations of the guarantee. The warranty does not cover:

Any dispute concerning these warranty conditions or their observance shall be settled primarily by mutual negotiation. In the event of failure to reach an agreement in mutual negotiations, disputes arising from the agreement shall be settled by the Hämeenlinna District Court. Finnwind Ltd’s liability to the customer is limited to the purchase price of the product. It is the customer’s responsibility to ensure that the product is properly insured against third party risks. Non-warranty work will always be invoiced according to the applicable price list for alterations and additional work.

4) Warranty conditions for Solar C – solar packages for recharging batteries

Solar C solar packages that charge batteries have a 2-year warranty. The warranty only covers defects in raw materials, materials and workmanship. The warranty does not cover damage caused by defective equipment, replacement costs, any loss of production by the buyer, loss of profit or any other indirect costs. The guarantee is conditional on the installation being carried out in accordance with the regulations in force, generally accepted installation practice and the instructions for the installation, maintenance and use of the product. The warranty does not cover parts and equipment if the parts and/or equipment have been damaged by the customer’s own installation or by the customer’s own equipment. The warranty is conditional upon the goods being delivered to Finnwind Ltd for inspection at the customer’s (subscriber’s) expense.

5) Warranty conditions for solar panel installation systems – Finnwind Fast Sun installation systems

Finnwind Fast Sun solar panel mounting systems are guaranteed for 12 years for FS-H and 10 years for FS-M, FS-P, FS-S, FS-T, FS-J, FS-I, FS-B and FS-A.

The guarantee only covers defects in raw materials, materials and workmanship. The buyer must notify the guarantor of the defect without delay when he discovers the defect, but no later than one month after the defect was discovered. The guarantee does not cover damage caused by defective equipment, the cost of replacing the equipment, any loss of production by the buyer, loss of profit or any other indirect costs. 7) General terms of delivery

a) payment terms and delivery charges

Payment terms and delivery charges for our various products will be indicated in the offer. We reserve the right to accept or reject any offer made by our agent on our behalf. The delivery costs of the products indicated in the offer include delivery to the end of the motorway in mainland Finland, excluding Åland. If you live, for example, on an island where there is no road access, please indicate this separately when placing your order to clarify the delivery method and delivery costs. We may check our customers’ credit information before signing the contract and if the customer has credit problems, we reserve the right to change the payment terms.

b) delivery time

Unless a delivery time has been agreed separately, Finnwind Ltd (the seller) will determine the delivery time. An intermediate sale condition applies to offers immediately from stock, in which case the product in stock can be sold to another customer during the period of validity of the offer. If the manufacturer of the goods or the party from whom the seller obtains the goods has not fulfilled its agreement and the seller’s delivery is delayed as a result, the seller is not liable to compensate the buyer for any damage caused by this.

Wind turbine installations

The price offered for wind turbine installations assumes that the installation site is accessible by car, that the site is sufficiently accessible in terms of topography and soil or bedrock to allow for installation, and that there is sufficient space for lifting and lowering the turbine (e.g. the space required for lifting and lowering the turbines must be taken into account). Any additional work that may deviate from the normal installation, such as e.g. removal of obstacles, felling of trees bushes, etc. will be invoiced separately. If the wind turbine foundations are carried out by someone other than Finnwind Ltd or a Finnwind Ltd authorised installer, the price quoted assumes that the wind turbine foundations have been laid in accordance with Finnwind Ltd’s foundation guidelines and that access to the installation site is by car. It is the customer’s responsibility to identify/identify any electrical cables, water and drainage pipes, etc. that may already be present in the ground. Solar photovoltaic system installations

There shall be no snow, ice or other obstructions on the roof to impede installation. Access to the site is by car and the products can be delivered to the site yard by crane truck if necessary. When installed on the roof, the panels will be installed in line with the roof slab and can be placed on the roof according to the basic solar panel layout in the Annex without any modifications. The basic price does not include the drawing of any necessary building permit drawings and/or the services of a competent master craftsman as may be required by the building control authorities, nor the necessary certification inspection for blocks of flats and terraced houses with more than two residential apartments. In the event of inaccessibility by car, eaves heights of more than 3.8 metres, roof pitches of more than 33 degrees or the need for additional shutters/shut-off boxes, a surcharge will be added to the standard installation price in accordance with the price list. The cable run from the solar panels to the inverter charger will not exceed 20 metres. If the site is not accessible by car, the eaves height is more than 3,8 m or the roof is steeper than 33 degrees, a surcharge will be added to the standard installation price according to the price list. In addition, for installations with a tiled roof, a tile roof surcharge will be added to the installation price and it is the customer’s responsibility to ensure that a few spare tiles are available on site if necessary. For wall-mounted solar panels, the standard installation price does not include any additional work that may be required to structurally reinforce the wall, and for underground and rock-mounted solar panels, the standard installation price does not include the earthworks for the underground cable duct and/or the underground mounting racks. In the case of a site without a built-in potential equalisation point, earthing shall be carried out as an additional work. Any disagreement concerning the Agreement shall be settled primarily by mutual negotiation. If no agreement can be reached in mutual negotiations, disputes arising from the agreement will be settled by the Hämeenlinna District Court.
